1.- Purpose and General Information

These General Terms and Conditions (hereinafter, the "General Terms") govern the purchase of products through the website www.gemelolandia.com (hereinafter, the “Website” or the “Portal”), owned by the company Otief Innovacion SL (hereinafter, “OTIEF”), with N.I.F. B72966146, registered in the Madrid Mercantile Registry, in volume 44.785, folio 44, sheet M-603691, first entry, whose registered office is at Calle de la Paloma 35, LOCAL, 28981 Parla / Madrid, Spain.

By purchasing any of the products on the Website, the user (hereinafter, the “User”) fully accepts all of these General Terms and Conditions without reservation. By accepting these General Terms, the User's data will be added to OTIEF's files and will be processed in accordance with the Privacy Policy, which the User explicitly declares to know and accept.

By accepting the General Terms, the User guarantees:

-        That they are legally capable of contracting.

-        That they have read, understood, and accepted these General Terms.

OTIEF provides information about its products and offers the possibility of purchasing them through the Website. Those wishing to acquire products must complete the registration form during the purchase process and follow the steps OTIEF communicates via the Website.

These General Terms, together with the Legal Notice of the Website and the Privacy Policy, are the only conditions applicable to the use of the Website and the purchase of products through it, replacing any other conditions, unless otherwise agreed in writing between OTIEF and the User. Accordingly, any User accessing the Website, registering, and purchasing products through the Website agrees to be bound by the General Terms, the Legal Notice, and the Privacy Policy as they are written at the time of access. The User will always have access to the General Terms prior to starting the purchase process, and they may be stored and/or reproduced on a durable medium.

All Users accessing the Website must be at least 18 years old.

2.- Product Information

Photographs, graphic or iconographic representations, and videos related to OTIEF products, as well as trade names, brands, or distinctive signs of any kind contained on the Website. Partial cancellation of the order does not entitle the User to cancel the entire order, without prejudice to the exercise of the right of withdrawal as established in these General Terms.

All products sold on www.gemelolandia.com are manufactured under strict quality control and comply with all European Union health regulations.

Note: OTIEF tries to make the color of the cufflinks displayed on our Online Store as close as possible to the real color. However, the exact color may vary due to factors such as photo quality, lighting, monitor settings, or other factors beyond our control. If you have any questions regarding the color of any of our models, please contact us.

3.- Product Purchase System

To purchase a product, the User must select the desired product and add it to the cart by clicking the “Buy” icon. Once the products are selected, the User must click “View Cart” and then “Place Order”. The User will then be asked to enter shipping details and, if desired, register. The User must fill in the personal data displayed on the screen, accepting the Privacy Policy and these General Terms, and click “Place Order” to proceed with the purchase.

The customer must provide personal data to process the order; otherwise, the order cannot be shipped or processed.

The username and password provided to OTIEF are personal and non-transferable identifiers required to access and make purchases. The username cannot be changed by the User, but the password can, in which case the modified credentials will become valid.

Once the User has selected the products and, if applicable, registered, they will validate the payment method by clicking “Place Order”, follow the on-screen instructions, and accept the purchase, which constitutes the irrevocable acceptance of these General Terms.

After completing the purchase, within twenty-four (24) hours, OTIEF will send an acknowledgment email to the User. The User may request, and OTIEF will send, the corresponding invoice.

All products available on the Website are displayed with a description, price, and other relevant information.

4.- Product Prices

Product prices on the Website include VAT and any other applicable taxes, as well as shipping costs, as detailed in the “Place Order” section.

Taxes, fees, and shipping costs vary depending on the shipping location and products ordered.

OTIEF reserves the right to change prices at any time. Products will be invoiced at the price listed on the Website at the time of order registration.

5.- Payment of Products

The User agrees to pay at the time of order. Shipping fees will be added to the product price and communicated to the User before completing the purchase.

Payment can be made via credit/debit card (Visa, Mastercard, American Express, Visa Electron, or similar), bank transfer, or PayPal.

The User must notify OTIEF of any fraudulent or unauthorized charges via email [email protected] or phone +34 918 332 055 as soon as possible.

OTIEF uses the highest commercially available security measures. Credit/debit card and PayPal payments are processed via SSL (Secure Socket Layer) encryption, ensuring data is transmitted securely.

-        Data is sent only to OTIEF's server.

-        Data is encrypted, preventing third-party access.

OTIEF does not access payment details; only Bankinter / Sermepa and PayPal do.

6.- Delivery Time, Place, and Loss

6.1- Delivery of Products

OTIEF delivers products in perfect condition to the address provided by the User. Please provide an address where delivery can occur during normal business hours.

OTIEF is not responsible for errors due to incorrect or incomplete addresses.

Products will be delivered to the indicated person/company and address within the specified timeframe. Delivery is available in countries where the system allows user registration. Contact [email protected] other locations.

Acceptance and payment of the order imply acceptance of the shipping method and costs. Orders cannot be shipped to P.O. boxes.

OTIEF reserves the right to withhold orders with incorrect addresses. Customer service will contact the User for any issues.

Products are shipped only to countries listed in the One Step Checkout. No shipments outside this area.

6.2.- Delivery Timeframe

Delivery within Spain: 24-48 working hours for express, 4-5 days for standard; Canary Islands, Ceuta, Melilla: 72-120h, subject to customs. International: 7-10 days in Europe, 15-45 days elsewhere, from payment date.

Delays will be communicated. Delivery is considered completed when the courier makes the product available to the Customer.

6.3.- Delivery Data, Failed Deliveries, and Loss

If absent, the courier leaves instructions to reschedule. If delivery is not arranged within 7 business days, the User must contact OTIEF. Otherwise, after 10 business days, the order will return to OTIEF, and the User will bear shipping and associated costs.

6.4.- Diligence in Delivery

The User must check the package with the courier and report any issues to OTIEF via email [email protected] within 2 months of delivery.

6.5.- Shipping Costs

Shipping is free or €5 in Spain; international shipping €10 + 21% VAT. Only one shipment per order. Additional addresses require €6 per address. International orders cannot change delivery address once shipped.

7.- Product Returns

(i) Right of Withdrawal

The User has 14 calendar days to withdraw without justification, starting from the day they or a third party other than the courier acquire possession.

To exercise this right, notify OTIEF SL, C/ Paloma 35, Local, Parla 28981, Madrid, email: [email protected], +34 918 332 055 via an unequivocal statement. A withdrawal form is provided but not mandatory.

Withdrawal consequences: OTIEF will refund all payments, including delivery (except extra costs from a different delivery method), within 14 calendar days via the same payment method.

Refund may be withheld until goods are received or proof of return is provided.

Return goods to OTIEF without undue delay and within 14 days of withdrawal notice. Return costs borne by User. User liable only for decreased value from non-essential handling.

Exclusions: custom-made, perishable, sealed health/hygiene products, or unsealed audio/video/software.

(ii) Order Cancellation

Orders can be canceled within 2 hours by emailing [email protected]. OTIEF will confirm cancellation and refund the payment.

After sale completion, cancellations are not accepted.

The User is entitled to a refund or replacement of defective or incorrect products. Return shipping will be arranged by OTIEF’s courier; two attempts will be made. If unsuccessful, User must ship at own expense.

OTIEF is responsible for non-conformities within two years. User must notify within 2 months of discovery.

(iv) Product Refunds

OTIEF will refund the purchase price once the return complies with procedures. OTIEF does not cover return costs for withdrawals. Partial returns result in partial refunds. Refunds processed within 48 hours; card refunds up to 7-14 days depending on the bank.

8.- Modification of General Terms

Users always have access to the General Terms. Acceptance is required prior to purchase.

9.- Communications between OTIEF and the User

All communications will be in writing according to procedures in these General Terms.

10.- Integrity of General Terms

These General Terms, the Privacy Policy, and Legal Notice constitute the full agreement between OTIEF and the User, replacing any prior agreements.

11.- Partial Invalidity

If any clause is declared null, it will be removed or replaced without affecting the rest.

12.- Applicable Law
